Terms and conditions
Version date: 23 March 2010.
These terms and conditions explain your rights and obligations when using the Archyve website. Please read them carefully as your continued use of this website indicates that you accept them. Please contact us with any enquiries or comments.
We reserve the right to change these terms and conditions at any time. Subscribers to our email Mailing List will be notified of such amendments.
Neither party shall be held liable for any breach of these terms and conditions that is caused by a matter beyond its reasonable control.
Our Privacy policy forms part of these terms and conditions.
Acceptance and jurisdiction
Your continued use of this website indicates your acceptance of these terms and conditions which thereby form an agreement that is deemed to be made in England and is subject to English law and the exclusive jurisdiction of the English courts.
Copyrights
All copyrights, trademarks, patents, design rights, and other intellectual property rights relating to our website are reserved.
Purchasing
To purchase goods or services from us you must be at least 18 years old.
Orders are subject to acceptance and product availability.
We advise you to print a copy of your order for your future reference.
Whilst we take great care to ensure the advertised price and other product descriptions are fair and true, we cannot guarantee 100% accuracy. In particular, we verify the price information of every order received and, in the case of a discrepancy where the true price is lower, we will supply the goods at the lower price. If the true price is higher we will either (at our discretion) contact you with the option to purchase at the higher price (if you choose to cancel the order you will, of course, receive a full refund), or cancel the order.
Most orders (excluding pre-orders, see below) are despatched within 48 hours, so if your item has not been delivered within 14 days, please contact us. If your item has not arrived within thirty days (starting the day after you placed your order), we will offer you a full refund (including the cost of postage and packing).
Pre-ordered items are usually despatched to arrive by their official launch date although this cannot be guaranteed. UK customers are advised to place pre-orders at least seven days before the publication date, customers elsewhere in the world should pre-order at least fourteen days before the publication date.
We shall not be liable to you for any loss or claim arising from your failure to provide us with accurate and/or up to date contact details.
If you pay with a credit or debit card, the transaction should appear on your card statement in the form PAYPAL *WAVEWRIGHTS. This is because Archyve is the publishing wing of WaveWrights (wavewrights.com).
Our Returns and refunds policy below forms part of these terms and conditions.
Returns and refunds policy
If you wish to return an item we sent to you because...
...it arrived damaged or defective:
please email us with a description of the damage or defect, and we will send you a reply-paid envelope for its return to us along with the original packaging. We strongly recommend that you obtain a Proof of Posting certificate from your Post Office (or equivalent evidence if not posted in the UK) before returning the item to us, and address it clearly for the attention of the Returns Department at our usual postal address. If the item fails to arrive back with us, we should still be able to offer you a free replacement so long as you are able to produce proof of posting, otherwise we may not. Once we have processed the returned item, we will replace it free of charge.
...you have changed your mind and do not want it:
please inform us in writing (preferably by email) within seven working days (starting the day after you received the item), and within thirty days we will refund the cost of the item and the cost of delivering it to you. You will be responsible for returning the item to us, and for the cost of returning it. While the item is in your possession, you have a statutory duty to take reasonable care of it, and should the item be returned to us in an unacceptable condition (or fail to arrive back with us), we have the right to charge you for it and the cost of its delivery to you. Refunds during this seven day cooling-off period are not available for inscribed books, which have been personalised for you by the author.
...we sent you the wrong item:
please email us, and we will send you a reply-paid envelope for its return to us. We will then send you the correct item free of charge.
Notes
Our Returns and refunds policy does not affect your statutory rights.
We normally make refunds using the same payment method by which you made the purchase.
You can expect to receive your refund within 28 days of returning the item.
Should the item you ordered be unavailable for any reason, we will refund your money promptly and in full.
We are happy to comply with the Distance Selling Regulations, which offer consumers in the European Union a significant level of protection when ordering goods and services from websites.
